Legal Warranty

As a consumer, you have legal rights when purchasing products from By Maysa. This page explains your rights under Dutch and European law.

Conformity guarantee

All products we sell must match the description, be suitable for their intended use, and be of normal quality. If a product does not meet these requirements, you are entitled to:

  • Repair or replacement of the product
  • Price reduction
  • Termination of the purchase agreement

Warranty period

The statutory warranty is valid for two years from the date of delivery of the product. For second-hand products, this period can be shortened to a minimum of one year.

Specific for Jewelry

Jewelry has the same 2-year warranty period. We distinguish between:

  • Covered under warranty: Defects in material or workmanship, such as faulty closures, discoloration due to poor materials, or jewelry that does not match the product description
  • Not covered: Normal wear and tear from everyday use, such as minor scratches, loss of shine over time, or damage from improper maintenance.

The quality and price of the jewelry partly determine what is considered 'normal quality'.

How to claim warranty

To exercise your warranty rights:

  1. Please contact us at [your contact details]
  2. Describe the problem with the product
  3. Please include your proof of purchase
  4. We will respond within a reasonable time

Burden of proof

During the first 6 months after delivery, it is presumed that a defect was already present at the time of delivery, unless this presumption is incompatible with the nature of the product or the nature of the defect. After this period, you, as the consumer, must demonstrate that the defect was already present at the time of delivery.

Commercial warranty

In addition to the statutory warranty, we can also offer a commercial warranty. This additional warranty does not affect your statutory rights.
